Raphael Jesurum, a specialist public law Barrister at 36 Immigration , looks at the new Illegal Migration Bill and some of the arguments available to help your clients if the new provisions become law.

The Bill will introduce several ouster clauses which try to exclude the supervisory jurisdiction of the High Court - we look at how those have been treated by the Courts in the past, and whether they will be effective

We look at some of the provision of the Bill, and the Nationality and Borders Act 2022 which lay down timetables for the provision of evidence, and some of the legal tools available to ensure access to justice
